TERMS AND CONDITIONS AGREEMENT
The Omega Project – Real Estate Photography Services

- Scope of Services
The Omega Project provides real estate photography and videography services, including but not limited to interior and exterior property photography, drone/aerial footage, virtual tours, and video editing.
All services provided will be specified in a signed agreement, invoice, or confirmation email prior to the session.

- Scheduling & Cancellations
• Booking: Sessions must be booked at least 48 hours in advance, subject to availability.
• Cancellation Policy: Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled appointment. Late cancellations may incur a fee of [$25].
• Weather Delays: In the case of inclement weather (for drone work or exterior photography), sessions may be rescheduled at no additional cost.

- Client Responsibilities
• The property must be photo-ready at the time of the appointment. The Omega Project is not responsible for cleaning, staging, or rearranging furniture.
• Pets and personal items should be secured or removed prior to the shoot.
• The client (or their authorized representative) must ensure access to the property at the agreed time.

- Turnaround Time
Edited photos will be delivered within [24–48] hours of the shoot via digital download unless otherwise specified. Video edits and virtual tours may require [3–5] business days.

- Payment Terms
• Payment is due upon delivery unless otherwise agreed in writing.
• Accepted methods include credit/debit card, PayPal, CashApp, or direct bank transfer.
• A late fee of [$25] may apply to invoices unpaid after [5] days.

- Usage Rights & Licensing
• The Omega Project grants the client a non-exclusive, non-transferable license to use the delivered media for marketing and promotional purposes related to the sale or lease of the property.
• Media may not be sold, transferred, or reused for another property or client without written permission.
• The Omega Project retains copyright and may use media for portfolio, promotional, or advertising purposes unless the client opts out in writing.

- Drone & FAA Compliance
Drone photography services are subject to FAA regulations. If conditions (e.g., flight restrictions, weather, or no-fly zones) prevent drone usage, alternatives will be discussed or services may be adjusted/refunded accordingly.

- Revisions & Re-shoots
• Minor retouching is included in the service price.
• Re-shoots due to property unpreparedness or client changes (not related to photographer error) will incur additional fees.

- Liability
The Omega Project is not responsible for any damage to the property or items within during the shoot, unless caused by negligence. The client assumes all responsibility for ensuring the property is safe for equipment and personnel.

- Termination
Either party may terminate the service with written notice. If terminated after the shoot has occurred, payment for completed work is still required.

- Governing Law
These terms shall be governed by and interpreted under the laws of the State of Michigan.

- Acceptance
By booking a service with The Omega Project, you (the client) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Non-Refundable Items
- Travel surcharges, rush fees, and optional add-ons (virtual staging, floor plans, etc.) are non-refundable once performed or delivered.
- Third-party platform fees (e.g., MLS upload, advertising boosts) arranged on the Client’s behalf cannot be refunded.
Refund Method & Timeline
- Approved refunds are returned to the original payment method within 5–7 business days of confirmation.
- Credits are applied automatically to the Client’s Spiro account and visible at checkout.
How to Request a Refund or Re-shoot
- Email support@omegaprojectmedia.com within 7 days of delivery.
- Include booking ID, property address, and description of the issue.
- We will respond within 1 business day with next steps.
Force Majeure
Neither Party is liable for delays caused by acts of God, pandemic restrictions, or other events beyond reasonable control. Timeline extends for the period of the delay.
Independent Contractor
Provider is an independent contractor; nothing herein creates employment, partnership, or joint venture.
